TERMS OF SERVICE AGREEMENT

PLEASE READ THIS TERMS OF SERVICE AGREEMENT CAREFULLY. BY ACCESSING OR USING OUR SITES AND SERVICES, YOU AGREE TO BE BOUND BY THE TERMS INCORPORATED HEREIN. IF YOU DO NOT AGREE TO ALL OF THESE TERMS, PLEASE DO NOT USE OUR SITES OR SERVICES. THIS AGREEMENT IS EFFECTIVE AS OF THE DATE YOU FIRST ACCESS OUR SERVICES.

1. ACCEPTANCE OF TERMS

This Terms of Service Agreement (“TOS”) is a legally binding agreement between you (“User” or “Member”) and GoExpand™, located at 7887 E. Belleview Ave. Suite 1100 Denver, Co. 80111. This TOS governs your use of the website, including goexpand.com (“Site”) and its associated services (“Services”).

2. DESCRIPTION OF SERVICES

GoExpand™ provides a web-based application for performance management, engaging all employees, managers, vendors, partners, and more. Visitors to our Site are deemed “Users.” Registered individuals are deemed “Members.” By registering, Users and Members agree to the terms of this TOS. GoExpand reserves the right to modify, suspend, or discontinue any part of the Services without liability.

3. VERSION SUPPORT AND CANCELLATION POLICY

For supported versions of our Services, GoExpand requires a 60-day notice for cancellation. For unsupported versions, a 30-day notice is required. Failure to provide adequate notice will result in continued charges.

4. REGISTRATION REQUIREMENTS

To register as a Member, you must be at least 18 years old and comply with all applicable laws. By registering, you agree to provide accurate, current, and complete information and to update this information as necessary. GoExpand reserves the right to suspend or terminate accounts with false or incomplete information.

5. PRIVACY POLICY

Your registration data and personal information are protected under our Privacy Policy, available at https://goexpand.com/privacy-policy. By using our Services, you consent to the data practices described in our Privacy Policy.

6. MEMBER ACCOUNT, PASSWORD, AND SECURITY

You are responsible for maintaining the confidentiality of your account and password and for all activities conducted through your account. You agree to notify GoExpand immediately of any unauthorized use of your account.

7. USER CONDUCT

You agree not to use the Services for any unlawful or prohibited activities, including but not limited to the dissemination of harmful, offensive, or illegal content. GoExpand reserves the right to remove any content and suspend or terminate access to the Services for any violation of the TOS.

8. MODIFICATIONS TO THE SERVICE

GoExpand reserves the right to modify or discontinue the Services with or without notice. GoExpand is not liable to you or any third party for any modification, suspension, or discontinuance of the Services.

9. TERMINATION

You may terminate your account by providing the required notice via email to support@i2o.294.myftpupload.com. GoExpand may suspend or terminate your account immediately for breach of the TOS, legal requirements, inactivity, or other reasons as deemed necessary.

10. LIMITATION OF LIABILITY

GoExpand is not liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of the Services.

11. GENERAL PROVISIONS

• Entire Agreement: This TOS constitutes the entire agreement between you and GoExpand.
• Choice of Law: This TOS is governed by the laws of the state of Texas.
• Severability: If any provision is found invalid, the remainder of the TOS remains in full force.
• Notice: Expand may provide notices by email, mail, or postings on our website.
